AREAS OF PRACTICE

SIILVERMAN, SILVERMAN & SELIGMAN, P.C. is a professional corporation representing Claimants throughout the Capital District. Unlike some firms, we do not have a firm "jingle", do not shout loudly on TV or mark the countryside with huge, shouting billboards. What we do, rather, is provide the finest representation of Claimants in four areas of the Law, Workers' Compensation, Social Security Disability, Long Term Disability and Negligence/Malpractice.

Workers' Compensation ("Comp") is an administrative legal process involving hearings before an Administrative Law Judge. SILVERMAN, SILVERMAN & SELIGMAN, P.C. attends hearings and represents Claimants at all local hearing points including Menands, Schenectady, Queensbury and Hudson. We have handled literally tens of thousands of hearings and recognize when to compromise and when to stand firm. Our experience includes taking a great deal of medical testimony, both before the Administrative Law Judge (ALJ) and by deposition. "Comp" cases can take a long time - and it is important to be represented by a firm that is prepared and ready to proceed when a hearing is set. Our office speaks regularly with the Client, particularly before upcoming hearings and meets with all clients scheduled for testimony in preparation thereof. We are always mindful of the possibility of a good settlement.

Social Security Disability ("SSD") is also an administrative legal process, but a Federal administrative legal process. While a "Comp" claim may involve numerous hearings, an "SSD" claim usually has only one. This hearing is generally longer than a "Comp" hearing and is usually more "technical", more "legal" in appearance, often relying on and making reference to Federal Statutes, Rules and Administrative Decisions. Our experience in handling tens of thousands of "Comp" hearings translates nicely and has been extremely important in our thirty years of handling SSD claims.

Long Term Disability ("LTD") claims often arise out of private contracts between a Claimant and an insurance carrier. The problem arises when the insurance carrier deems that the Claimant does not meet the stated disability criteria and denies benefits, despite medical reports to the contrary from the attending physicians. SILVERMAN, SILVERMAN & SELIGMAN, P.C. represents Claimants in such actions against the insurance carrier and often tries to "settle" these cases due to the lengthy litigation period that would otherwise be involved.

Negligence claims are familiar to everyone and there are firms shouting from the rooftops, inundating the television waves, and capturing every 1-800 number in existence. SILVERMAN, SILVERMAN & SELIGMAN, P.C. sees it differently. Our office often associates with other firms in the prosecution of Negligence claims. Why? Because our expertise together with an associated firm provide the best possible legal representation. If the claim is a fall down on municipal property, we will associate with the attorneys demonstrating the most experience in that field. We will associate with the attorney with the most experience in handling swimming pool accidents, or machine malfunctions, or falls from high places or medical or legal malpractice. It provides an extra benefit to the Client at no additional cost.
